The New York market
In New York City, permits come from the Department of Buildings. A gas water heater, gas furnace or gas boiler swapped in kind must be filed by a Licensed Master Plumber, either as a Limited Alteration Application (LAA1) or, since an April 2, 2026 industry notice, as ordinary plumbing on form OP128:HHW with a chimney affidavit and a $130 fee for 1 to 5 family buildings. Homeowners cannot self-file plumbing. The LAA1 route bars self-certification, so inspections apply. Housing here leans on boilers and basements: EIA's 2020 survey found 35% of New York State homes heat with a steam or hot water boiler and only 29% use central air. The Jersey City, Newark and Long Island parts of the metro have their own building departments, so these rules cover the five boroughs only.
Most city houses keep a gas tank heater in the basement venting into a masonry chimney. That chimney's condition is the first thing to ask about, since a new tank can draft poorly in a flue that is cracked or oversized. Statewide, EIA counts 57% of homes heating water with gas and 11% with fuel oil, so an oil-fired or boiler-fed tank is still common. No city page addresses electric water heater swaps, so check with the Department of Buildings first.
